These Terms of Use explain the rules for using Capybara Passport: Merge Journey and this website, both published by Cycle Pty Ltd.

Acceptance of terms

By using the website or the app, you agree to these Terms. If you do not agree, please do not use them.

License

Cycle Pty Ltd gives you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial entertainment, subject to these Terms and any platform rules that apply.

Permitted use

• Please use the app and website lawfully and only for their intended purpose.
• Please do not interfere with normal operation, attempt unauthorized access, or misuse purchase, save, or platform systems.
• Please do not copy, sell, redistribute, reverse engineer, or create commercial derivative works from the app except where applicable law clearly allows it.

User responsibilities

You are responsible for your device, your platform account, your internet connection, and your use of the app and website. You are also responsible for making sure your use complies with applicable law and with any app store or platform rules that apply to you.

In-app purchases

The app may offer optional one-time consumable purchases, including gameplay items such as energy refills or cooldown skips. Prices, availability, and billing terms are set through the relevant app store, and payment processing is handled by the platform provider.

Restores and availability

If you reinstall the app or move to another device under the same store account, please use the in-app Restore Purchases feature. Cycle Pty Ltd cannot guarantee that every feature, offer, or item will always be available without interruption, and reserves the right to change, remove, reprice, or discontinue content, items, features, and offers at any time.

Intellectual property

The app, website, artwork, writing, screenshots, branding, code, audio, and related content are owned by or licensed to Cycle Pty Ltd and are protected by applicable intellectual property laws.

Updates and changes

Cycle Pty Ltd may update, change, suspend, restrict, or discontinue parts of the app, website, or content over time. Features shown in screenshots or marketing materials may evolve as the game grows, and we are not required to continue supporting any specific feature, item, reward, or service indefinitely.

Disclaimers

The website and app are provided on an "as is" and "as available" basis to the fullest extent permitted by law. Cycle Pty Ltd disclaims all warranties, representations, and conditions of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, and availability. Cycle Pty Ltd does not guarantee that the app or website will always be error-free, uninterrupted, secure, or compatible with every device, network, browser, or configuration.

Limitation of liability

To the fullest extent permitted by law, Cycle Pty Ltd and its directors, officers, employees, contractors, licensors, suppliers, and service providers will not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, business opportunity, data, use, savings, or access, arising out of or related to the app, the website, these Terms, or your use of or inability to use the app or website, even if advised of the possibility of such damages.

To the fullest extent permitted by law, the total aggregate liability of Cycle Pty Ltd arising out of or relating to the app, the website, or these Terms is excluded entirely, and where complete exclusion is not permitted by law, that total aggregate liability is limited to AUD $0.00 or, if a court determines that amount cannot be enforced, the minimum amount permitted by applicable law.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy that cannot lawfully be excluded, restricted, or modified. Where liability cannot be excluded but can be limited, Cycle Pty Ltd limits its liability to the fullest extent permitted by law.

Indemnity

You agree, to the fullest extent permitted by law, to indemnify and hold harmless Cycle Pty Ltd and its directors, officers, employees, contractors, licensors, suppliers, and service providers from and against any claims, demands, actions, losses, damages, judgments, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to your misuse of the app or website, your violation of these Terms, or your violation of any law or third-party right.

Termination

These Terms remain in effect until terminated. Your right to use the app or website may end immediately if you violate these Terms. You may stop using the app and website at any time.

Governing framework

These Terms work alongside any mandatory consumer rights and platform terms that apply where the app is distributed. If one part of these Terms cannot be enforced, the rest will still apply. Any waiver of a provision must be in writing, and any failure to enforce a provision is not a waiver of future enforcement.

Jurisdiction

To the fullest extent permitted by law, these Terms are governed by the laws applicable in the jurisdiction in which Cycle Pty Ltd is established, without regard to conflict of law rules, and you submit to the exclusive jurisdiction of the courts of that jurisdiction except where mandatory consumer law provides otherwise.
